Terms and Conditions
Last updated: 2026-09-21 | Effective: 2026-09-21 | Applies to orders delivered in Australia
These Terms and Conditions (“Terms”) govern your use of the website moorgen.homes (the “Site”) and any order you place with us for Moorgen products in Australia. Please read them carefully before ordering. By using the Site or placing an order, you agree to these Terms.
1. About us
The Site is operated by GETOO PTY LTD (ABN 88 625 513 751), trading as “Moorgen Australia” (“we”, “us”, “our”). Our address is 197 Young Street, Waterloo NSW 2017, Australia. You can contact us at info@moorgen.au or +61 497 007 777.
We are the authorised distributor of Moorgen products in Australia. The Moorgen global website at moorgen.de and the Moorgen Life application are operated by Moorgen Deutschland GmbH, a separate entity. Those services are not governed by these Terms, and where you use them the privacy policy and terms of that entity apply.
These Terms, together with our Privacy Policy, Shipping Policy, Refund & Returns Policy and Warranty Policy (each available on the Site), form the agreement between you and us.
2. Your rights under the Australian Consumer Law
Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)) or any other law that cannot lawfully be excluded, restricted or modified.
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and for compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
Our services come with guarantees that cannot be excluded under the Australian Consumer Law, including that services will be provided with due care and skill, will be fit for any purpose you have made known to us, and will be supplied within a reasonable time.
If anything in these Terms is inconsistent with the Australian Consumer Law, the Australian Consumer Law prevails to the extent of the inconsistency.
3. Using the Site and placing an order
- You must be at least 18 years old to place an order. If you are under 18, a parent or guardian must place the order and accept these Terms on your behalf.
- You must give us current, complete and accurate information when you create an account or place an order, and keep it up to date so that we can complete your order and contact you.
- You are responsible for keeping your account login details secure and for activity under your account.
- You must not use the Site for any unlawful purpose, or interfere with its operation or security (see section 17).
We may refuse service, close an account or decline an order where it is reasonably necessary to do so — for example where we suspect fraud or unlawful conduct, where you breach these Terms, where there is a product safety, supply or export issue, or where we are required by law. We will not refuse service on any basis that would be unlawful discrimination.
4. Orders, prices and payment
- Your order is an offer to buy. A contract is formed only when we accept your order, which happens when we dispatch the goods (or, for pre-orders, when we confirm dispatch arrangements). An order confirmation email is not acceptance.
- All prices shown to customers in Australia are in Australian dollars and, where GST applies, are inclusive of GST. Delivery charges and any other mandatory charges are shown at checkout.
- Prices, product descriptions and availability may change at any time, but a change will not affect an order we have already accepted.
- If a pricing or description error affects an order we have already accepted, we will contact you and offer you the choice of continuing at the corrected price or cancelling for a full refund.
- You authorise us to charge your nominated payment method for the total amount of your order, including delivery and applicable taxes.
- Payments are processed by Stripe (through WooCommerce Payments) and PayPal. We do not store your full payment card details.
5. Delivery, title and risk
- Delivery timeframes are estimates only and are set out in our Shipping Policy. We will notify you if a delay is substantial.
- Title in the goods passes to you on delivery. Risk of loss or damage passes on delivery to the address you nominate, or, where you nominate your own carrier, when the goods are handed to that carrier.
- You may cancel an order and receive a refund if a delay is substantial and caused by us.
- Where delivery is affected by an event outside our reasonable control, we will use reasonable endeavours to minimise the delay and will keep you informed.
6. Products, availability and product information
- Products are offered subject to availability. We may limit quantities or discontinue a product where reasonably necessary.
- We take care to display products accurately, but we cannot guarantee that the colours and finishes you see on your screen exactly match the physical product.
- Our products are electrical goods supplied for use in Australia. They are intended to comply with applicable Australian electrical safety and radio communications requirements and, where applicable, carry the RCM mark.
- Any wall plate, hub, gateway or accessory that is not included with a product is stated on the product page and is sold separately.
7. Installation and electrical safety
- Our products must be installed by a licensed electrician in accordance with the AS/NZS 3000 Wiring Rules and the electrical safety laws of your State or Territory.
- You must isolate the power at the switchboard before any installation or adjustment work.
- We are not responsible for any fault, damage, loss or injury caused by installation or modification by a person who is not a licensed electrician, or by use of a product in a way that is inconsistent with the installation instructions supplied with it. This does not limit your rights under the Australian Consumer Law.
8. Consumer guarantees, repairs and warranty
If a product fails to meet a consumer guarantee, you may be entitled to a repair, replacement or refund, and to compensation for any other reasonably foreseeable loss or damage. How you are entitled to a remedy depends on whether the failure is major (see section 2).
To make a warranty or consumer guarantee claim, contact us at info@moorgen.au with your proof of purchase, the product serial number and a description of the problem. We may ask for photos or video to help us assess the claim.
9. Refunds and returns
Our Refund & Returns Policy sets out how change-of-mind returns are handled. Nothing in that policy limits your rights under the Australian Consumer Law: if a product is faulty, damaged or not as described, you are entitled to a repair, replacement or refund, and you cannot be required to pay for return shipping for a faulty product.
10. Intellectual property
- The Site and its content — including text, images, product designs, trade marks and layout — are owned by us or our licensors.
- You may view, download and print material from the Site for your own personal, non-commercial use only.
- You must not reproduce, adapt, publish or exploit any part of the Site or its content for commercial purposes without our written permission.
11. User content, reviews and feedback
- If you post a review, comment or send us feedback, ideas or suggestions (“User Content”), you grant us a non-exclusive, royalty-free licence to use, reproduce, edit and publish that User Content in connection with our business and products.
- Your User Content must not be unlawful, defamatory, obscene, misleading or infringe the rights of any person, and must not contain viruses or malicious code.
- We may remove User Content that we reasonably consider breaches these Terms, but we are not obliged to monitor it.
- You remain responsible for your User Content and for its accuracy.
12. Third-party links, tools and services
- The Site may link to third-party websites and services (for example payment providers, delivery tracking, social media and the Moorgen global site). We are not responsible for their content, privacy practices or terms.
- If we give you access to any optional third-party tool, we provide it “as is” and “as available”, without warranties other than those that cannot lawfully be excluded, and your use of it is at your own risk.
13. Personal information and privacy
We handle personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles. Our Privacy Policy explains what we collect, why, who we disclose it to, and how you can access, correct or complain about it. It is available at https://moorgen.homes/privacy-policy/.
Some of the service providers we use are located outside Australia. The countries in which your personal information is likely to be stored or accessed are set out in our Privacy Policy. By providing your personal information you consent to those disclosures for the purposes described in that Policy.
14. Cookies and analytics
We use cookies and similar technologies to run the Site, remember your preferences and understand how the Site is used. We currently use Google Analytics 4, loaded through Google Tag Manager. You can manage cookies through your browser settings; blocking some cookies may affect features such as the cart and checkout.
15. Direct marketing
- We only send marketing emails or SMS with your consent, or where the law otherwise permits it.
- Every commercial electronic message includes a functional unsubscribe facility and our contact details, as required by the Spam Act 2003 (Cth).
- You can opt out at any time using the unsubscribe link or by contacting us; we will action it within a reasonable time.
- We do not sell your personal information.
16. Prohibited uses
You must not use the Site or its content:
- for any unlawful purpose, or to encourage anyone else to do something unlawful;
- to breach any law of the Commonwealth of Australia or of any State or Territory, or any other applicable law;
- to infringe our intellectual property rights or those of anyone else;
- to harass, abuse, threaten, defame or discriminate against any person in a way that is unlawful;
- to provide false or misleading information, or to impersonate any person;
- to transmit viruses, malware or any code that may damage or interfere with the Site or any other system;
- to collect personal information about others, or to spam, phish, scrape or crawl the Site;
- to interfere with or bypass the security features of the Site.
We may suspend or terminate your access to the Site if you breach this section.
17. Availability of the Site
We aim to keep the Site available, but we do not promise it will be uninterrupted or error-free. We may suspend or change the Site for maintenance, upgrades, security or operational reasons. Where it is practicable, we will give you notice of significant interruptions.
18. Suspension and termination
- You may stop using the Site at any time.
- We may suspend or terminate your access if you materially breach these Terms, or where we are required to do so by law.
- Except in urgent circumstances — for example suspected fraud, unlawful conduct, a product safety risk or a legal obligation — we will give you reasonable notice and, where practicable, an opportunity to remedy the breach.
- Termination does not affect amounts already due, or rights and obligations that accrued before termination.
19. Warranties and disclaimers
- Subject to section 2, and to the maximum extent permitted by law, the Site and the products and services supplied through it are provided “as is” and “as available”, and we do not promise that your use of the Site will be uninterrupted, timely, secure or error-free.
- Subject to section 2, we do not promise that any information on the Site is complete, current or free from error, and information on the Site is general information, not advice.
- Nothing in this section excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law.
20. Limitation of liability
- Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded.
- Where the Australian Consumer Law allows us to limit our liability for a failure of a consumer guarantee, and the goods or services are not of a kind ordinarily acquired for personal, domestic or household use, our liability is limited, at our option, to: (a) for goods — repairing or replacing the goods, supplying equivalent goods, or paying the cost of doing so; and (b) for services — supplying the services again, or paying the cost of having them supplied again.
- Subject to the first two points, we are not liable for indirect, incidental, special or consequential loss, or for loss of profit, revenue, savings, goodwill or data, except to the extent that loss is a reasonably foreseeable loss arising from our failure to comply with a consumer guarantee.
- Where any law permits a limitation that would otherwise be void, our liability is limited to the maximum extent permitted by that law.
21. Indemnity
You indemnify us, and our officers, employees and agents, against loss or liability we suffer arising from your breach of these Terms or your unlawful act, to the extent that loss or liability was caused by you. This indemnity does not apply to the extent the loss or liability was caused by us, and does not limit your rights under the Australian Consumer Law.
22. General
- Severability — if any part of these Terms is unlawful, void or unenforceable, it is enforceable to the fullest extent permitted by law and, to the extent it cannot be enforced, it is severed. The rest of these Terms continues to apply.
- No waiver — if we do not enforce a right immediately, we do not lose that right.
- Assignment — you may not assign your rights under these Terms without our written consent. We may assign or novate our rights in connection with a reorganisation, sale or transfer of our business or assets.
- Force majeure — we are not liable for a failure or delay caused by an event outside our reasonable control, provided we take reasonable steps to minimise its effect.
- Entire agreement — these Terms and the policies referred to in them are the entire agreement between you and us and replace any earlier version.
23. Governing law
These Terms, and any separate agreement under which we supply goods or services to you, are governed by the laws of New South Wales, Australia. Nothing in this section excludes the operation of the Australian Consumer Law or deprives you of any protection that cannot lawfully be excluded.
24. Changes to these Terms
- You can review the current version of these Terms at any time on this page.
- We may update these Terms by publishing a revised version. Changes take effect 7 days after publication and do not apply to any order we have already accepted.
- For material changes, we will also notify you by email or by a notice on the Site.
- Your continued use of the Site after the changes take effect means you accept them.
