Privacy Policy
This Privacy Policy explains how GETOO PTY LTD (ABN 88 625 513 751), trading as “Moorgen Australia” (“we”, “us”, “our”), collects, holds, uses and discloses personal information through our website moorgen.homes, our online store, the Moorgen Life application and the Moorgen smart devices we supply in Australia.
We are bound by the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). This Policy is written to meet the requirements of APP 1 (open and transparent management of personal information), including APP 1.4: the kinds of information we collect and hold, how we collect and hold it, the purposes for which we collect, hold, use and disclose it, how you may access and correct it, how you may complain, and whether we are likely to disclose it to overseas recipients and, if so, which countries.
The Moorgen global website (moorgen.de) and the Moorgen Life platform are operated by Moorgen Deutschland GmbH, a separate entity. Where you pair a device purchased from us with that platform, personal information will be disclosed to them as described in section 10 of this Policy.

3. How we collect personal information
- Directly from you — when you create an account, place an order, contact us, submit a warranty claim, subscribe to our newsletter or use the app;
- Automatically — through cookies, log files, web beacons and similar technologies when you use our website, and through telemetry from paired smart devices;
- From third parties — our payment provider confirms payment outcomes, our delivery partners provide delivery status, and the Moorgen Life platform provides device status, firmware and diagnostic information;
- From public sources or marketing lists, where permitted by law.
Where it is lawful and reasonable to do so, we will collect personal information only from you (APP 3). If we collect information about you from someone else, we will take reasonable steps to notify you (APP 5).
4. Why we collect, hold, use and disclose personal information
We collect, hold, use and disclose personal information for the following purposes:
- To supply products and services to you, process payments, arrange delivery and perform our contract with you;
- To screen orders for fraud and manage payment and credit risk;
- To provide warranty, repair, replacement and after-sales support, including product recalls and safety notices;
- To provide customer support and respond to your enquiries;
- To operate, maintain, secure and improve our website, app and products, including analytics and product development;
- To send marketing communications where you have consented, and to manage your preferences and unsubscribe requests;
- To comply with legal obligations (including tax, consumer, product safety and electrical safety laws) and to respond to lawful requests from courts, regulators or law enforcement;
- To establish, exercise or defend legal claims, and to protect our rights, property and safety and that of our customers and the public;
- In connection with a reorganisation, merger, sale or transfer of our business or assets, in which case we will notify you of any change in ownership and the choices you have.
If we want to use or disclose your personal information for a purpose that is not set out above (a secondary purpose), we will seek your consent, or only do so where the APPs permit it (APP 6).
5. Anonymity and pseudonymity (APP 2)
Where it is lawful and practicable, you may deal with us anonymously or by using a pseudonym — for example, when browsing our website or making a general enquiry. We do need your real details where we are supplying goods to you, processing payment, arranging delivery, honouring a warranty or meeting legal obligations.
6. Cookies and analytics
A cookie is a small file downloaded to your device when you visit our website. We use: strictly necessary cookies (to run the store, cart and checkout); performance and analytics cookies (to understand how the site is used); and marketing cookies (to measure campaigns and show relevant advertising).
The analytics and advertising tools we currently use are Google Analytics 4, loaded through Google Tag Manager. You can control or delete cookies through your browser settings, and you can opt out of Google Analytics at https://tools.google.com/dlpage/gaoptout. Blocking cookies may affect parts of the site, such as the cart and checkout.
7. Direct marketing (APP 7, Spam Act 2003, Do Not Call Register Act 2006)
- We only send marketing emails, SMS or calls with your consent, or where the law otherwise permits it;
- Every commercial electronic message includes a functional unsubscribe facility and our contact details, as required by the Spam Act 2003 (Cth);
- You can opt out at any time by using the unsubscribe link, replying “STOP” to an SMS, or contacting us — we will action it within 5 business days;
- We do not sell your personal information, and we do not disclose it to third parties for their own direct marketing without your consent;
- Where we have your consent, we may disclose limited information to our service providers so they can send marketing on our behalf.
8. Who we disclose personal information to
We disclose personal information to the following types of recipients, for the purposes described above:
- Our payment provider Stripe (via WooCommerce Payments) and PayPal to process payments and screen for fraud;

- Manufacturers, repairers and warranty agents handling a claim on your behalf;
- Professional advisers (accountants, auditors, insurers, lawyers) and our bankers;

However, overseas recipients may be subject to foreign laws and disclosure requirements. By using our website, store, app or devices, and by providing your personal information, you consent to the disclosure of your information to the overseas recipients listed above for the purposes described in this Policy (APP 8.1). If those reasonable steps are not taken, we remain accountable under APP 8.1 for the acts and practices of the overseas recipient.
10. Security of personal information (APP 11)
We take reasonable steps to protect personal information from misuse, interference and loss, and from unauthorised access, modification or disclosure, including:
- Encryption of data in transit (HTTPS/TLS) and encryption at rest for confidential information;
- Access controls, authentication and least-privilege access for staff and systems;
- Device access isolation and authorisation, and access logging;
- Using a PCI-DSS compliant payment provider so that full card details are not stored by us;
- Staff training, confidentiality obligations and regular review of our security practices;
- Retention limits and secure destruction or de-identification of information we no longer need.
No system is completely secure. If you believe your interaction with us is no longer secure, or that your account has been compromised, please contact us immediately using the details in section 15.
11. Data breaches — Notifiable Data Breaches scheme
If a data breach involving your personal information occurs and it is likely to result in serious harm, we will notify affected individuals and the Office of the Australian Information Commissioner (OAIC) as required by Part IIIC of the Privacy Act 1988 (Cth). Our notification will include a description of the breach, the kinds of information involved and the steps you can take in response.
12. How long we keep personal information
We keep personal information only for as long as we need it for the purposes set out in this Policy, or as required by law. As a guide:
- Order, invoice and tax records: at least 5 years, as required by Australian tax and record-keeping laws (commonly 5–7 years);
- Warranty and service records: for the warranty period plus a reasonable period afterwards;
- Device and app data: while your device is registered, and for a reasonable period after you deregister it;
- Marketing consents and preferences: until you withdraw consent or opt out.
When information is no longer needed, we destroy it securely or de-identify it, where it is lawful and reasonable to do so.
13. Access and correction (APP 12 and APP 13)
- You may ask us for access to the personal information we hold about you, and ask us to correct it if it is inaccurate, out of date, incomplete, irrelevant or misleading;
- To make a request, contact our Privacy Officer using the details in section 15. Please tell us what information you want, or what correction you want made;
- We will respond to your request within 30 days (or within any longer period permitted by the Privacy Act, in which case we will tell you why);
- There is no charge for making a request. We may charge a reasonable cost-based fee for providing copies, and we will tell you before doing so;
- We will need to verify your identity before we can action your request;
- If we refuse access or correction, we will give you written reasons and tell you how to complain.
14. Children and young people
Our website, products and services are not directed at children. We do not knowingly collect personal information from children under 16 without the consent of a parent or guardian. You must be 18 or over to place an order with us, or have a parent or guardian place it for you. If you are a parent or guardian and believe your child has provided us with personal information, please contact us so we can delete it.

- Voice and microphone features collect audio only when you actively use them, and you can turn the permission off at any time;
- Where a device supports biometric features such as a fingerprint lock, the template is stored on the device wherever technically possible, and is only collected with your explicit consent;
- You can withdraw app permissions (location, camera, microphone, photos, Bluetooth, notifications) at any time in your device settings, which may disable the related features.

Our website and app may link to third-party websites and services (for example payment providers, delivery tracking, social media and the Moorgen global site). We are not responsible for the privacy practices or content of those services, and you should review their privacy policies before providing personal information to them.
